New Nashville Limousine Regulations: Judge Denies Motion to Dismiss Case

U.S. District Judge Kevin H. Sharp recently denied a motion to dismiss a pending civil rights lawsuit against the Metropolitan Transportation Licensing Commission (MTLC) and others which allege arbitrary and irrational regulations on Nashville limousine companies.

The plaintiffs in the civil lawsuit include drivers and Metro Livery Inc which is a competing Nashville limousine company which previously offered limousine rides for prices less than the new mandated requirements.  The plaintiffs are being aided by lawyers who work for the Institute for Justice.

The MTLC passed a series of limousine regulations which went into effect on January 1, 2012 and include the following:

  • Nashville limousine companies are required to charge a minimum fare of at least $45 per trip.
  • Prohibit the use of leased vehicles.  Limousine companies must hold title to their vehicles.
  • Operators must dispatch only from their place of business.
  • Nashville limousine companies may only operate vehicles which are seven model years old or newer for sedan and suv’s and no more than ten years old for limousines.
